Electoral Court Judgment on IEC Chairperson

20 June 2014

The Office of the ANC Chief Whip has noted the judgment and the recommendation to Parliament by the Electoral Court in a matter relating to the fitness to hold office of the Chairperson of the Independent Electoral Commission, Advocate Pansy Tlakula.

The Court`s recommendation for the removal of the Chairperson of the IEC is in line with the procedure outlined in the Electoral Commission Act, which grants the Court the powers to make such a recommendation for consideration by a committee of the National Assembly.

We also note the announcement by Adv. Tlakula that she intends asking the President to place her on leave while she appeals the judgment with the Constitutional Court. We welcome her decision to put the interest of the Commission ahead of her own by stepping aside while she exercises her rights in terms of the law.

In the light of her intention to challenge the ruling of the Electoral Court, we hold the view that the National Assembly should await the conclusion of the legal process before it exercises its obligations in terms of the law. It would indeed be premature and legally untenable for the institution to initiate a process and take a decision on a matter that is pending in Court.
