ANC Caucus vindicated by Western Cape High Court dismissal of Afriforum Interdict

The African National Congress (ANC) in Parliament feels vindicated by the decision of the Western Cape High Court to dismiss the application by Afriforum to interdict Parliament from adopting the report of the Constitutional Review Committee (CRC) recommending the amendment of Section 25 of the Constitution for the expropriation of land without compensation.

The ANC has always stated that this application was nothing but a desperate attempt to delay Parliament from responding to the quest of our people for the expropriation of land in the public interest.

In fact, the true intention of this application was to justify the violent dispossession of land. We condemn Afriforum's use of its position of wealth and privilege to abuse the judicial system with a view to undermine parliamentary process, render the voices of South Africans meaningless and to perpetuate their racially divisive ends.

Today's judgement is therefore not only a victory for Parliament, but also a victory for the majority of the people of South Africa who have made their voices heard in favour of land reform.

The ANC is now even more determined to ensure that this process is brought to its logical conclusion and quite certain that both the National Assembly (NA) and National Council of Provinces (NCOP) will favorably receive the recommendations made by the CRC to amend Section 25 of the Constitution for the expropriation of land without compensation.

The report of the CRC is scheduled for consideration and adoption by the NA and the NCOP on Tuesday, 04 December 2018. After both houses have adopted the report, Parliament will then initiate a process of the actual amendment of Section 25 of the Constitution.
